Abstract

This thesis research aims to theoretically explore recovery within the provisions of Restorative Justice for child cyberbullying offenders based on the Electronic Information and Transactions Law and to legally analyze whether legal efforts with a Restorative Justice approach for child cyberbullying offenders based on the Electronic Information and Transactions Law can be accepted.

This thesis research uses John Rawls' Theory of Justice, Fitzgerald's Theory of Legal Protection, and Utrecht's Theory of Legal Certainty. The methods used are Juridical Normative, Juridical Doctrinal, prescriptive in nature, employing the Statute approach, Conceptual approach, and Case approach, specifically the Judges' Decision Number 160/Pid.Sus/2020/Pn Bna.

Differences with previous research: (1) Selly Novita Sari that children who commit crimes, there are special regulations in the Child Criminal Justice System Law and the ITE Law, can be resolved through restorative justice with a diversion process; (2) Luh Putu Ayu Catur Adriani that the application of restorative justice in bullying crimes committed by minors; (3) Dewi Ervina Suryani that various obstacles in the application of restorative justice in child-on-child violence.

The findings of this research indicate that in the context of restorative justice, creating social harmony focuses on recovery involving the perpetrator, victim, family, and community. Restorative justice for children who are cyberbullying perpetrators within the scope of the ITE Law can be accepted if the principles of diversity and child protection approaches are optimally applied
