RESPONSIBILITY FOR THE DETENTION OF SEA VESSELS UNDER MARITIME JURISDICTION IN INDONESIA

This research aims to legally examine the Enforcement 3of Maritime Vessel Detention Law that violates the Navigation Law within the Criminal Justice System and to theoretically explore the Civil Legal Protection for Maritime Vessel Owners who commit Navigation violations within the jurisdiction of Indonesian waters.
This research uses the Authority Theory by Brownlie & Sadjipto Rahardjo, the Responsibility Theory by Hans Kelsen, Busyra Azeri & Abdulkadir Muhammad, Law Enforcement Theory by Friedman & Tom R. Tyler, Soerjono Sokanto, Legal Certainty Theory by Utrecht, Kansil & Han Kelsen. Maritime Security Theory by Geoffrey Till & Bateman.
The method used is normative and doctrinal juridical, prescriptive in nature with the Statute approach, Conceptual approach, and Case approach, namely the Decision of the Panel of Judges of the Central Jakarta District Court in Case Number 1231/Pid.Sus/2019/PN Jkt.Utr., and the Decision of the Panel of Judges of the Banyuwangi District Court in Case Number 474/Pid.B/2021/PN Byw, along with several other cases.
The results of this thesis research indicate that violations of Article 227 and Article 228 of the Maritime Law are categorized as criminal offenses and may be subject to administrative and/or criminal sanctions. Shipowners who commit navigation violations have the right to file an objection through pretrial proceedings and a counterclaim in civil court. Alternative efforts such as mediation mechanisms before escalation to court or international arbitration to resolve disputes with Indonesian authorities
