Abstract

This research aims to find theoretically about the protection of civilians oriented towards humanism in armed conflict as part of military interests and to analyze the legal consequences for perpetrators of hostage-taking of civilians according to International Humanitarian Law. This research uses the Theory of Justice by John Rawls, the Theory of Public Interest by Jeremy Bentham, the Theory of Legal Certainty by Utrecht, Van Apeldoorn, and Jan Michiel Otto, and the Theory of Law Enforcement by Soerjono Soekanto to answer the legal issues in this research.

The methods used are normative juridical and prescriptive doctrinal juridical using the Statute Approach, Conceptual Approach, and Case Approach approaches, including studies of the 1949 Geneva Convention and the 1977 Additional Protocol, the 1998 Rome Statute, and cases of crimes against humanity such as the South Sudan Tragedy and hostage-taking in armed conflict.

The findings of this thesis research show that the protection of civilians oriented towards humanitarianism must be a priority in every military operation, and the taking of civilians as hostages is a war crime that carries serious legal consequences for the perpetrators, including prosecution at the International Criminal Court. The implementation of international law into national law, such as through Law Number 26 of 2000 concerning the Human Rights Court, is key to ensuring justice for victims and encouraging global accountability.
