Abstract

The licensing system touches lives because it is linked to activities that require the attention of government officials in the form of permits. Andalalin's authority falls under the authority of the Minister, Chief of Police, Governor, Regent/Mayor in relation to enforcing traffic and road transport laws. The role of this official is very important. However, UULLAJ as a lex specialis does not regulate the responsibility of implementers who fail to complete Andalalin. This research focuses on discussing the regulation of Traffic Impact Analysis (Andalalin) for business actors and the sanctions. This research is classified as normative legal research which is carried out by examining library materials to look for legal principles, both ideal elements that produce legal rules through legal philosophy and real elements that produce certain legal systems. This research concludes that the regulation of Andalalin in the licensing system to ensure the security and safety of public road users is part of the road construction permit as a decision of government organs which must not conflict with the principle of legality. Regarding sanctions for business actors who do not comply with Andalalin documents in road infrastructure design, if a traffic accident occurs causing road users to suffer losses, they can be held responsible based on Article 99 of Law Number 22 of 2009 concerning Road Traffic and Transportation in conjunction with PP No. 30 of 2009. 2021 concerning the Implementation of Road Traffic and Transportation, the maximum penalty according to Regional Regulations is 6 months. However, in its implementation, administrative sanctions are often given based on Article 82 of Law Number 2 of 2022 concerning Job Creation which emphasizes the existence of administrative sanctions for environmental violations in the form of: Written warnings/warnings; Government coercion; Administrative fines; Attempted freezing; and/or Revocation of business license
