LEGAL PROTECTION FOR LOCAL DOCTORS AGAINST THE PRESENCE OF FOREIGN DOCTORS IN INDONESIA BASED ON HEALTH LAWS

In the current era of globalization, the government cannot stem the flow of foreign workers to Indonesia. The policies and regulations that have been made by the government to provide protection for local doctors are being questioned. The arrival of foreign doctors to Indonesia provides great benefits so that they can increase the expertise of doctors in Indonesia, it is hoped that this can improve the performance of local doctors in the health sector. However, the influx of foreign doctors in Indonesia is still a problem, especially the issue of the number of foreign doctors who will be brought in and how local doctors are legally protected against the influx of foreign doctors entering Indonesia. In terms of regulation, the government has still not created and studied the limits on the number of foreign doctors brought to Indonesia, resulting in a legal vacuum. The formulation of the research problem is how to regulate the ratio of foreign doctors based on Law Number 17 of 2023 concerning Health and how to legally protect local doctors against the presence of foreign doctors. The type of research used is normative legal research, which is a type of legal research obtained from library studies, with a legal issue through regulations, literature, and other reference materials, as well as the examination of regulations. The conclusion of this research is that there are currently no regulations governing the ratio of local doctors to foreign doctors; the health law also does not explain the regulation of that ratio, and the country has not yet provided maximum protection for the presence of foreign doctors, as there are no rules limiting the presence of foreign doctors.
