Abstract

In Article 87 of the Criminal Code, it is explained that desertion is leaving service within 30 days, running away from one's task force during combat, either intentionally or unintentionally without the commander's permission. The threat for deserters is disciplinary punishment, imprisonment and even dismissal from military service. This research focuses on discussing the provisions for examining criminal cases of desertion in absentia against TNI members who disappeared during assignment, and relates to the rights of TNI members who are apparently ignored during examinations at the Military Court in absentia. This research is classified as normative legal research which is carried out by examining library materials to look for legal principles, both ideal elements that produce legal rules through legal philosophy and real elements that produce certain legal systems. The research conclusions are: 1) TNI-AD members who deserted at the Military Court examination in absentia were interpreted as an examination at every stage until a verdict was handed down. The examination of the case in absentia is based on Article 143 of Law Number 31 of 1997 concerning Military Justice which mandates the court to decide on the defendant at least 6 months from the defendant and legal summons has been attempted 3 times in a row. legal enforcement and certainty; 2) Legal decisions against members of the TNI-AD who are deemed guilty during examinations at the Military Court in absentia are regulated in the special KUHPM Article 124 paragraph (4) regarding examinations in absentia which can be carried out in the case of desertion case files where the suspect is not found; and Article 141 paragraph (10) in cases of desertion where the Defendant is not found, the examination is carried out without the presence of the Defendant.
