THE DISTRIBUTION AND SALE POLICY OF SUBSIDIZED FUEL IS MISUSED BY A PERTAMINA OFFICER

This research aims to theoretically find the form of legality of the distribution and sale of subsidized fuel based on Law Number 6 of 2023 concerning Job Creation, and (2) analyze the legal implications of law enforcement against the misuse of the distribution and sale of subsidized fuel after the enactment of Law No. 6 of 2023 concerning Job Creation.
This research uses the Welfare State Theory by R. Kranenburg & Bagir Manan, the Licensing Theory by J.B.J.M Ten Berge & Philipus M Hadjon, and the Justice Theory by Aristotle, Hans Kelsen & John Rawls.
The methods used are normative and doctrinal juridical in nature, prescriptive in approach, employing the Statute approach, Conceptual approach, and Case approach, namely the Judges' Decision Number 555/Pid.Sus/2023/PNBjm, Judges' Decision No.54/Pid.Sus/2020/PN Pmn, and the Supreme Court Decision Number 97/Pid.Sus/2022/PNSnt.
Differences with previous research: (1) Muhammad Bustan stated that the regulation of the misuse of distribution and trade of subsidized 3 kg LPG gas in South Kalimantan cannot be prosecuted under Article 55 of the Oil and Gas Law because the investigators from the Special Criminal Investigation Directorate of the South Kalimantan Police always have their application of this article rejected by the Public Prosecutor on the grounds that Article 55 only applies to fuel oil, not including natural gas (LPG); (2) Dian Sekar Sari mentioned that the Judges' Council Decision No. 230/Pid.Sus/2014/Pn.Bkl found the Defendant guilty of violating Article 55 of the Oil and Gas Law, and the judge should have imposed a heavier sentence than what the Prosecutor demanded to create a deterrent effect by applying criminal law violations under 2 articles, namely Article 53 letters (b) & (d) and Article 55 of the Oil and Gas Law; (3) Zaenal M.P stated that the form of law enforcement against perpetrators of the crime of transporting and selling subsidized fuel oil in Pohawato Regency was decided with either administrative sanctions or criminal sanctions.
The findings from this research indicate that the Distribution and sale of subsidized fuel through digitalization serves as a form of transparency to ensure it targets the right recipients according to subsidy criteria, in order to avoid misuse by certain individuals that harm the state and society. Law enforcement becomes more structured, focusing on eradicating corruption, deviations, and administrative violations.
