BALANCE OF WORKERS' RIGHTS IN TERMINATIONILLEGAL EMPLOYMENT RELATIONSHIP BY COMPANY

This research aims to theoretically explore the protection and legal guarantees of workers' rights in unlawful termination of employment (PHK) by companies and to legally analyze the workers' legal efforts to reject and sue companies that unlawfully terminate employment through the Industrial Relations Court until the final decision. This research uses Aristotle & John Rawls' Theory of Justice, Fitzgerald's Theory of Legal Protection, and Utrecht & CST.Kansil's Theory of Legal Certainty (Legality).
The methods used are normative juridical and doctrinal juridical, which are prescriptive in nature, employing the Statute approach, Conceptual approach, and Case approach, namely Supreme Court Decision Number 33K/Pdt.Sus-PHI/2021, Supreme Court Decision Number 822 K/Pdt.Sus-PHI.2022, Judge's Panel Decision Number 353/Pdt.Sus-PHI/2021/PN.Jkt.Pusat, and Judge's Panel Decision Number 507.K/Pdt.SusPHI/2022/Pn.Mdn.
Difference from previous research: (1) Mawardi Khairi states that the legal efforts that can be undertaken by workers who feel aggrieved due to termination of employment to restore their rights are litigation efforts through the court and non-litigation efforts through bipartite or tripartite means. (2) Guntur Putra Ramadhan stated that layoffs based on Law No. 6 of 2023 concerning Job Creation are prohibited from being carried out unilaterally without clearly informing the plan and information. Unilateral termination can harm and undermine the values of the 1945 Constitution and Pancasila in protecting the rights of the nation's children.; (3) Yoan Ean Yuri stated that the termination in this Omnibus Law is not much different from previous legal instruments, although there are provisions for sanctions against employers who terminate unilaterally.
The findings from this research indicate that the protection and guarantees provided by legal instruments for workers against unlawful termination aim to ensure justice and balance of rights between workers and employers.The government, companies, and workers must contribute to creating a harmonious and balanced industrial relationship.Legal actions that workers can take if the termination is proven to be illegal, workers are entitled to recovery or compensation according to the applicable regulations.
