Abstract

This study analyzes child custody for children growing up without a father's role based on Indonesian Civil Law (KUH Perdata) and Islamic Family Law (Compilation of Islamic Law/KHI). Using a normative juridical approach, the research finds that KUH Perdata emphasizes the best interest of the child with priority given to the mother as guardian, while KHI incorporates sharia principles granting custody (hadhanah) to the mother until the child reaches 12 years old for boys and 9 years old for girls, with transfer according to the child's welfare. The comparison highlights the need for harmonization to protect children from psychological and social impacts due to the absence of the father, recommending strengthening the state's role in supervision.
