CHALLENGES OF FAMILY LAW IN FACING CONTEMPORARY SOCIAL TRANSFORMATION

Social transformation triggered by globalization and technological disruption has fundamentally changed the landscape of family interactions. This article aims to analyze the challenges of family law in Indonesia in responding to dynamic contemporary social dynamics. The main problem examined is the existence of "cultural lag" or the gap between family law regulations which tend to be static and rapidly changing social realities, such as the childfree phenomenon, shifting gender roles, and digital era divorce. This study uses a qualitative method with a juridical-sociological approach. The study results show three main findings: (1) The transformation of gender roles demands a redefinition of the concept of nusyuz and the rights and obligations of husband and wife; (2) The digital era raises the complexity of proof in religious court procedural law related to electronic evidence; (3) The shift in the philosophical values of marriage requires progressive legal ijtihad. It is concluded that legal harmonization through regulatory reform, strengthening mediation, and adaptive judicial interpretation is urgently needed to maintain the relevance of family law as an instrument of justice and social resilience.
