TRANSFORMATION OF THE CONCEPT OF JARIMAH INTO THE INDONESIAN NATIONAL LEGAL SYSTEM: A STUDY OF CONSTITUTIONALITY AND HARMONIZATION OF ACEH QANUN JINAYAH

The concept of jarimah in Islamic criminal law holds a fundamental position in defining criminal acts and their sanctions. The implementation of Qanun Jinayah in Aceh Province represents a tangible manifestation of the transformation of this concept into the Indonesian positive legal system, legitimized by special autonomy (Law No. 11 of 2006). This study aims to analyze the form of transformation of the jarimah concept, the legal standing of the Qanun within the national hierarchy, and the challenges of harmonization with Human Rights (HAM) principles. This study employs a normative-juridical method with conceptual and statutory approaches. The results indicate that Qanun Jinayah is a form of "positivization" of Islamic Sharia, possessing a constitutional, autonomous, and integral standing within the framework of the Unitary State of the Republic of Indonesia. This transformation converts religious norms into state legal norms. However, legal harmonization continues to face challenges, particularly regarding physical sanctions (uqubat), which are often viewed as conflicting with international human rights standards and the national Criminal Code (KUHP). The study concludes that harmonization must be achieved through aspirational legislative mechanisms and a Maqashid Sharia approach to ensure legal validity.
