LEGAL CERTAINTY IN PROBLEM SOLVING BY BHAYANGKARA FOR PUBLIC SECURITY AND ORDER

Abstract

Bhabinkamtibmas has the main task of providing legal guidance and counseling to the community, as well as acting as a mediator in resolving cases that do not involve formal legal processes. They function as a liaison between the community and the policeThe type of research used in this study is normative law research. The results of the research: First: The concept of problem solving by Bhabinkamtibmas in resolving minor crimes through mediation is carried out by Bhabinkamtibmas in carrying out its role as Community Policing which has the authority to take the first action before entering the investigation and investigation process. Second: From the perspective of legal certainty of problem solving in the settlement of criminal cases by Bhabinkamtibmas in terms of the format of the peace agreement, there is a standard format in the appendix to Police Regulation Number 8 of 2021 concerning the Handling of Crimes Based on Restorative Justice that there is no legal prosecution of each other in the future even though there is a possibility of violation of the agreement on the ability to compensate from one of the parties and repeating his actions again.
