ENFORCEMENT OF SANCTIONS FOR ENVIRONMENTAL POLLUTIONIN BARITO KUALA REGENCY

This study aims to analyze the provisions of law enforcement regarding environmental pollution in Barito Kuala Regency and the role of the Regional Government in creating local legal products aimed at protecting the environment from degradation, pollution and damage.
Therefore, the author conducted a normative-empirical research analyzing legal materials and descriptive qualitative data obtained from the results of the literature and questionnaires from the community regarding environmental management and environmental impacts related to Environmental Criminal Law Enforcement, analyzing related concepts and theories and concepts so that they can conclusion is drawn. Law enforcement against cases of environmental pollution violations in Barito Kuala Regency is caused by business owners, and in law enforcement, administrative sanctions are carried out. In addition to administration in law enforcement, there are three instruments, namely administrative law enforcement, civil law enforcement and criminal law enforcement. The government, the community, and business/activities implementers should obey and carry out the existing rules to maintain environmental sustainability, actively monitor the possibility of pollution so that the environment is protected from damage, and take firm action against the perpetrators of pollution by giving strict sanctions.
